When a party disagrees with a court’s ruling on alimony and equitable distribution, what is the standard the appellate court uses to review these types of awards? This was an issue in the case Abbey v. Abbey, 3D2024-1622 (Fla. 3d DCA October 1, 2025).
The former husband in this case appealed the trial court’s award of durational alimony to the former wife and the equitable distribution findings. The appellate court summarily affirmed, holding “Upon review of the record, we find the trial court’s durational alimony award and its division of assets within the equitable distribution scheme are supported by competent substantial evidence. We therefore affirm.” The court also dismissed the portion of the appeal as to an award of attorney’s fees to the former wife as a premature appeal since the amount was not yet determined.
