When a domestic violence injunction is entered against a party in Florida, and it is appealed, the appellate court evaluates the case under an abuse of discretion standard and determines whether the injunction is supported by competent, substantial evidence. This was an issue in the case Lau v. Gonzalez, 3D24-1491 (Fla. 3d DCA April 30, 2025).
The party against who a permanent domestic violence injunction was entered appealed the ruling. However, he did not provide a transcript of the trial. The appellate court therefore held “Without a transcript of the hearing on Gonzalez’s petition for injunction for protection against domestic violence, we are unable to evaluate Lau’s arguments and determine whether the trial court’s judgment is unsupported by competent, substantial evidence. As such, we are compelled to affirm.”
